Navigating the Renters’ Rights Act 2025
The first phase of the Renters’ Rights Act commenced on the 27 December. The Act introduces new duties and powers for local authorities in England to investigate whether Agents and Landlords are adhering to certain laws and will have a new statutory duty to enforce legislation. For example, they can investigate matters relating to illegal eviction.
A local housing officer, authorised in writing by the local authority, will be able to:

Enter a business premises without a warrant, at any reasonable time and by giving the occupier of that business at least 24 hours’ notice (unless the occupier waives this requirement).

The notice of entry must be in writing, specify that it is given under section 114 of the Renters’ Rights Act 2025 and explain the consequences of not giving information.

Request information from all “relevant persons”; Landlords, agents, banks and even neighbours. Officers can request information from anyone who has acted in the past twelve months as a landlord, agent, licensor or marketer or had an interest in the accommodation.

The officer will have powers to seize all documents and evidence in relation to the investigatory matter.
The notice does not require a person to provide the information, and they will not be guilty of an offence if they have given a reasonable excuse for why they have not given the information and can refuse giving information if it might incriminate them.
Fines
Authorities can impose higher civil penalties for breaches of obligations, with fines:

Up to £7,000 for initial breaches.

Up to £40,000 for persistent or repeated violations.
